Another Preventable Tragedy: Illegal Immigrant Released by Sanctuary Policies in Fairfax County Allegedly Murders Man One Day Later


Here we go again. In yet another glaring example of how Democrat-run sanctuary policies put American lives at risk, an illegal immigrant from El Salvador with a rap sheet longer than a Porto-San line on Octoberfest was cut loose by authorities in Fairfax County, Virginia, only to allegedly commit a murder the very next day.

Marvin Morales-Ortez, a 23-year-old illegal alien and suspected MS-13 gang member, was in custody on Tuesday facing charges of malicious wounding and brandishing a firearm. But thanks to the office of Soros-backed Commonwealth's Attorney Steve Descano, those charges were dropped, and he walked free. 

By Wednesday, a man was found shot dead in his Reston home, and Morales-Ortez was the prime suspect. After a manhunt involving drones, K-9s, and helicopters, he was tracked down and arrested on second-degree murder charges.


"The charges were nolle prossed due to insufficient evidence to move forward with the criminal case," a spokesperson for the Fairfax County Commonwealth’s Attorney Office, headed by George Soros-backed Fairfax County Commonwealth Attorney Steve Descano, told Fox News Digital. "The victim told police that they had moved out of the country and would not be coming to court to cooperate in proceedings, regardless of timing. Sadly, without the victim’s necessary testimony, we could not move forward."

Court records paint a disturbing picture: Morales-Ortez has been charged with at least seven crimes in Fairfax County since 2020, including a previous first-degree murder charge that was also dropped (someone else was later convicted). He's only been convicted once, for theft, and was fined $300, which he still hasn't paid.

Both the police and Descano's office pointed fingers at the sheriff's office, led by Stacey Kincaid, for handling ICE detainers. And sure enough, ICE had lodged a detainer, but Fairfax County's sanctuary policies meant it wasn't honored, unless there's a judicial warrant, which ICE didn't provide in this case.

"The Fairfax County Sheriff’s Office follows all local, state, and federal laws when determining whether a person is subject to release from the ADC. Immigration and Customs Enforcement (ICE) is automatically notified any time a person is booked into the ADC. In this instance, ICE was aware of Morales Ortez’s incarceration and elected not to seek a judicial warrant to ensure he remained in custody," Fox News Digital was told. "Accordingly, and consistent with our policies and the law, once the court issued an order dismissing his cases, Mr. Morales Ortez was released. "The Department of Homeland Security wasn't having any of the blame-shifting.

"This is nothing more than sanctuary politicians trying to pass the blame for their REFUSAL to protect American citizens," the spokesperson said. "To honor a detainer, officials do NOT need a judicial warrant. The sanctuary politicians of Fairfax have blood on their hands. They should have turned this serial criminal illegal alien over to ICE law enforcement--instead they chose to RELEASE him back into Virginia neighborhoods."

Critics like Sean Kennedy of Virginians for Safe Communities piled on, calling out Descano's track record.

"For Steve Descano’s office, letting violent criminals out to commit more crimes isn’t a bug, it’s a feature. But he bungles so many cases you can’t always tell where the incompetence ends and the ideology begins," Sean Kennedy, Virginians for Safe Communities president, told Fox News Digital. "That a dangerous offender would go free and create more victims is so commonplace in Fairfax that may have become numb to it. Descano exploits that."

This isn't some isolated screw-up—Fairfax County has long been criticized as one of the nation's most egregious sanctuary jurisdictions, routinely ignoring ICE detainers and prioritizing "trust" policies over public safety. Under the incoming Trump administration, ICE arrests in Virginia have surged, highlighting some of the "worst of the worst" criminal aliens recently nabbed. But tragedies like this one show the deadly cost of local officials playing politics with immigration enforcement.

How many more Americans have to die before these sanctuary politicians finally put citizens first?
