NY City law allowing aliens to vote ruled unconstitutional in appellate court

A New York state appeals court has denied a self-serving Democrat attempt by New York City top Democrats to implement a law that would let non-citizens vote [Democrat] in local elections, thus guaranteeing the Democratic Party absolute power for now and forever.

In a 3-1 ruling issued Wednesday by the Appellate Division for the Second Judicial Department, the body said the law violated the New York Constitution and Municipal Home Rule Law, and while they didn't say it, the idea that people from other countries can come to the United States, receive taxpayer-funded benefits that even American citizens aren't entitled to, is an abomination.

It "must be declared null and void," the court said in a 43-page ruling.

Finally, sanity wins.

The law had passed in December 2021 by the City Council and created a class of "municipal voters," [aka make-believe citizens] comprising non-citizens who reside in the city for at least a month before an election and register or pre-register to vote.

Municipal voters [aka illegal Democrats] would be granted the right to participate in elections for mayor, public advocate, comptroller, borough president and council member.

The bizarre law faced legal challenges almost immediately because it takes away the voting power of legal residents of the city.

It would have applied to some 800,000 new eligible voters in a city of 8.5 million. However, the appellate court said that the clause in the state constitution that says "every citizen shall be entitled to vote…" applies exclusively to U.S. citizens. This reference to "every citizen" does not apply to "every citizen of planet Earth," but to the U.S.

"As there is no reference to non-citizens, and thus, an irrefutable inference applies that non-citizens were intended to be excluded from those individuals entitled to vote in elections," the court said.

New York Democrat Mayor Eric Adams enacted the law upon taking office in January 2022. It was ruled illegal several months later. The mayor defended the law and appealed a lower ruling against it because he felt it interfered with his right to remain mayor and keep his party in power. It isn't known whether Adams will appeal the Wednesday ruling.

Many Democrats championed the left-wing centric law, saying it would make the city's politics more inclusive, while Republicans contended it could lead to voter fraud and that Democrats were only looking to pad their numbers, which we all know is true.

"Great news! We won in the appellate court and @NYCMayor’s attempt to implement the law to register non-citizens to vote in #NYC elections has been struck down," U.S. Rep. Nicole Malliotakis, (R-NY) posted on X. "This is a big victory in preserving both the integrity of our elections & the voice of American citizens!

Malliotakis represents New York's borough of Staten Island. She was one of several plaintiffs to sue over the law, along with Borough President Vito Fossella.

"Fortunately, common sense prevails in New York, thanks to the decision reached by the Appellate Division, Second Judicial Department. The New York State Constitution is clear in that only citizens can vote in our local elections. It is simply irresponsible and nonsensical to extend this right to non-citizens. We are pleased that the Appellate court shared this understanding. This is a win for New York citizens and upholds the integrity of our elections," Fossella said.

The New York Immigration Coalition said it was disappointed in the ruling as it was hoping to hand over even more benefits of entering the United States illegally.

The ruling comes as New York City is grappling with a surge in illegal aliens, some of whom are known terrorism associates. The influx has resulted in an increase in crime, violence, and anger from residents. In December, Adams warned that the so called sanctuary city was at its "breaking point" as city resources and shelter services had become strained.

Judge McAfee to rule in Fani Willis--Trump Georgia case

Final arguments are being prepared in the Trump election interference case as to whether Fulton County District Attorney Fani Willis should be disqualified due to her intimate relationship with the special prosecutor Nathan Wade.

Willis hired Wade rather than using the lawyers in her own office, and it is alleged that Wade was romantically schtupping her since 2019. She is paying Wade over $650,000 which is more than any of her lawyers are paid, and the kicker is that Wade has relatively no experience in RICO cases as this one happens to be.

It is also alleged that Willis personally benefitted from what she paid to Wade having taken elaborate and frequent vacation cruises with him, which may account for her rather full figure because it's always "all you can eat" on cruises. She claimed to have paid Wade back for her part of the expenses, but doesn't have a shred of evidence to prove that, claiming she always paid cash because she's black and you just don't understand.

After an excruciating drama-filled two-day hearing on the motion to disqualify Willis, we now await for the next steps.

There will now be an on-camera hearing with Judge Scott McAfee and the defense's "star witness" Terrence Bradley, the former divorce lawyer for Nathan Wade. This hearing is set for Monday February 26, according to Fox News.

On Friday, when Bradley testified, every question he received was immediately followed by an objection by the state and even his own lawyer.

The arguments centered on whether Bradley’s testimony would violate attorney-client privilege, since he was Wade’s divorce lawyer for a time. It's probable that not all the questions would violate that issue because Bradley was also Wade's friend and not everything is privileged outside of court when it doesn't directly involve Wade's divorce case.

Despite that, what is said on-camera, behind closed doors, could open things up in Bradley's testimony. Judge McAfee will determine how much of Bradley's testimony would violate attorney-client privilege and how much weight should be given the testimony that is admissible.

The next step expected would be a final hearing. The state and defense would sum up their evidence and give final arguments. That should be scheduled for next week if the source is correct. The exact date is to be determined.

Even if there is no conflict of interest in this case, which I suspect there is, just the appearance of such a conflict is enough to get Willis thrown off the case on her substantial duff. But it will be up to McAfee to decide what to do with what he hears.

It it was up to me, I'd throw her off the case, indict her for misuse of campaign funds [which she unintentionally revealed via her motor-mouth] and throw out the case overall. It's obviously a witch hunt, but it's the witch who's doing the hunting in this case.

Thomas Massie introduces bill to ditch Dept. of Education

One of the biggest wastes of taxpayer money, (besides everything beyond infrastructure, law enforcement and defense) is the Department of Education. It takes away local control of what is being taught in the classroom and does not serve to actually educate our children.

What this department actually does is indoctrinate the latest woke craze and turn the children into little lefty future Marxists. It's also the government's way of patting themselves on the shoulder while pretending to be doing something positive for the kids. And COVID-19 showed us their true colors as it was blatantly obvious that the Department of Education was not for the children, but for the teachers and staffing.

Rep. Thomas Massie (R-KY) believes the Department of Education needs to go, and he is exactly right.

On Wednesday Massie announced on X that he introduced H.R. 899, a bill that would obliterate the DoE, which is pronounced much like Homer Simpson's "D-oh," as well it should be.

"I introduced a bill to end the Department of Education," Massie posted. "We must return the money and authority back to states, school districts, teachers, and parents before it’s too late."

On Massie's website, the congressman goes into further detail and quotes former President Ronald Reagan who also wanted to collapse the Department of Education:
"Unelected bureaucrats in Washington, D.C. should not be in charge of our children’s intellectual and moral development. States and local communities are best positioned to shape curricula that meet the needs of their students. Schools should be accountable. Parents have the right to choose the most appropriate educational opportunity for their children, including home school, public school, or private school."
The DoE spends a crazy amount of money but of late has been reduced to spending $274 billion in 2023 from $638 billion the previous year. While that's a significant decrease, it's still more than the GDP of many small nations. Palau's 2021 GDP was about $324 million, not billion. Kiribati's GDP for the same year was $220 million. I'm not a math maven but I believe $324 million is even less than $1 billion.

It used to be said that cocaine was G-d's way of telling you that you're making too much money. Now it His way of saying we're financing a government department we don't even need. And the worst part is that the DoE breeds radicals who in turn bring in far left programs to the schools such as Critical Race Theory, "The 1619 Project," intersectionality, and LGBTQ curriculum.

In September of last year, the DoE decided to investigate author and educator Christopher Rufo for "misgendering" a DEI director at New College of Florida.

"Misgendering" happens when you notice the person you're speaking to or about is a male or female based on their biological characteristics rather than their delusions.

Massie has it right: the DoE is a waste of time, money, and needs to go away for good.

Putin flips us off by arresting U.S.-Russian citizen for donating $50 to Ukrainian charity

The Russian government has arrested Ksenia Karelina, a 33-year-old U.S. citizen, on charges of treason for simply donating a few dollars to a Ukrainian charity. This appears to be Putin's way of flipping off the United States, simply because he can and not worry that our president, a man who practically qualifies having his likeness on US paper currency if he were not so incompetent, would do anything about it.

The Federal Security Service (FSB) said in a statement that it arrested Ms. Karelina for donating $51.80 to Razom, a New York-based charity that sends assistance to Ukraine. The FSB is similar to our FBI in the US and they are obviously bias in their assessment of the situation.

“Since February 2022, she has been proactively collecting funds in the interests of one of the Ukrainian organizations, which were subsequently used to purchase tactical medicine items, equipment, weapons and ammunition by the Armed Forces of Ukraine,” the FSB said.

She was arrested in Yekaterinburg, a city in central Russia, after returning home to visit her family. If convicted, she faces up to 20 years in prison. She became a U.S. citizen in 2021 and should now be considered a hostage of the Putin government.

Her mother-in-law and ex-husband are begging the Biden administration to help get her freed so she can return to the U.S. Since she is not Israeli, it's more likely that Biden's handlers would do more to assuage the situation but don't count on it.

“We are all in shock,” Eleonora Srebroski, Karelina’s former mother-in-law, told the New York Post. “She is just a wonderful soul. She would never do anything evil to anyone. Knowing Ksenia, she would never do anything criminal. We are so worried because we are reading stories about [Alexei] Navalny’s supporters arrested for mourning him. Her mom and dad had recently divorced and she wanted to see the family.”

Former newspaper, The New York Times reported that she was charged with treason on February 7. It seems that 7 is no longer a lucky number for innocent people nowadays.

It was unclear how Russia knew that she allegedly donated money to the charity as it does not make records public in accordance with U.S. privacy laws.

“Razom is appalled by reports that a U.S.-Russian dual national has been arrested by Russian authorities for purportedly making a charitable donation to Razom for Ukraine in the immediate aftermath of Russia’s full-scale invasion of Ukraine,” Razom CEO Dora Chomiak said.

“Russian President Vladimir Putin has repeatedly shown that he holds no sovereign border, foreign nationality, or international treaty above his own narrow interest. His regime attacks civil society activists who stand up for freedom and democracy. Razom calls on the U.S. government to continue to do everything in its power to demand that President Putin release all those unjustly detained by Russia and to hold Russia’s political and military leadership accountable for their unprovoked invasion of Ukraine,” she added.

Karelina worked in Los Angeles as an aesthetician [a person who deals with beauty and art] and spa manager [a person who often deals with fat people] at a Beverly Hills hotel.

Yahya Sinwar's health deteriorating, has severe pneumonia: report

It may be just a rumor or a conspiracy theory, but it is believe that Yahya Sinwar may be suffering from a serious case of pneumonia, which cannot be serious enough if it doesn't kill him. N12 reported the Hamasshole former leader's situation on Tuesday, citing an anonymous Arab country that didn't want to be identified to avoid a nuclear conflagration.

The anonymous country in question said it had heard the report from senior Hamas officials who may have heard it from a friend who heard it from a friend, and so on.

According to the report, the country had been in contact with the terrorists, asking the Hamassholes to advance toward a ceasefire. Hamas subsequently responded that its situation was grave; it lacked ammunition, and its military structures were deteriorating.

How on Allah's scorched earth were they going to be able to annihilate the Jews and then destroy the United States?

On Tuesday, it was reported that Hamas’s leadership in Qatar and Gaza was unsure of where Sinwar was hiding. The Saudi newspaper Elaph said that Sinwar may have fled from the Gaza Strip to Egypt.

However, later on Tuesday, Kan News said that Sinwar had resumed communications with the Hamas leadership abroad, although his voice sounded shaky, and he kept saying how much he missed the brown, brown sand of home.

Speculations on Sinwar's fate come amid Defense Minister Yoav Gallant's statement that Hamas is in search of a replacement for Sinwar.

The notice read:

"Hamas Leader Needed. Must be dedicated to eradicating all non-believers, but willing to start with the Jews. Must be willing to travel and take risks. A self-starter is a plus. Weapons and ammunition provided by the Biden administration. Salary is negotiable."

Any takers?

Rear Admiral Rachel Levine's strategy to defeat the Houthis is transitional

Our finest men

Rear Admiral Rachel [was born Richard and often referred to by friends as "Dick"] Levine has voiced his concerns about the lack of a "manly" response by the U.S. Navy in response to Iranian-backed attacks by the Houthis.

Fun Fact: President Joe Biden sometimes refers to this naval enemy as "Houthis and the Blowfish," but mostly after the sun goes down.

Although Rear Admiral Levine never saw combat, we must take into account that the guy is a pediatrician and a graduate of Harvard University, where Claudine Gay had been president until her anti-Semitism got the better of her. Besides Marxism,

Levine might know a thing or two of handling the dreaded Houthis and rumor has it that he is planning to enlist the help of an expert in the field of nuclear waste. And if he plans to go through with his plans to defeat the Houthis, he might need the expertise of an expert on waste, nuclear and otherwise.

So naturally, his go-to-gay is nuclear waste guru Sam Brinton. They have set up a secret meeting in Jeddah where they will discuss strategy in a quiet little corner in the Brew92 coffee shop at 13:00 hours.

Levine, a Lindsey Graham style hawk, has voiced his concern that our handsome sailors are at extreme risk with those "nasty Houthis." He said, "If we have to stop them, I suggest we go full nuclear and blow them up. Once we win, we can transition to a mop up strategy."

H.S.boy who id's as a girl when playing against them in basketball, accused of injuring actual girls in game

A girls' basketball game between two Massachusetts high schools had a boy on one team who claimed to identify as a girl, in spite of his facial hair and his twigs and berries twixt his quads. It ended up where the all girls team forfeited against the team with the over six foot boy on it. [H/T Fox News Digital]

The all girls team, known as, the Collegiate Charter School of Lowell forfeited against KIPP Academy, which resides in Lynn, Massachusetts, that has the male 'ringer.' By halftime KIPP was leading 31-14, however the game goes into the record book as 10-0.

KIPP Academy is seen in a video showing the boy player wrestling the ball out of the hands of a girl who gets violently thrown to the floor boards, and appears injured. The boy scored an easy shot from beneath the basket that any ten-year-old could have made.

The girl from Collegiate Charter was seen grabbing her back in pain. You can see the video here on the X posting.

KIPP Academy did not immediately answer a request for clarification regarding the athlete’s gender identity or whether he pees in the vertical position.

Prior to this event and subsequent injury, two other girls had suffered injuries. Thus, the Collegiate Charter team that was only carrying an eight-player bench due to injuries in previous games but it isn't know if the injuries were due to boys running roughshod over the girls.

Collegiate Charter spokesperson Casey Crane released a statement which indicated the school’s approval of coach Kevin Ortins’ decision to forfeit at halftime, especially considering the team’s playoff game was close.

I believe the team should have forfeited before going out on the court if they knew the girls had to play against a boy [and screw the term 'biological boy,' that's the only kind of boy there is]. I have also suggested in previous blog posts that when females know that they are competing against males in sports that require strength and speed, they should refuse to participate at the last minute. If, for example, at a swim meet or running sprint race, women who see men on the starting platform or racing blocks, should wait for the gun to go off and just stand there and let the male swim or run by himself. That would be totally special to watch, but girls first need to band together and decide to do it.

I blame the coaches who allow this crap to take place with their women/girls' teams. Women's sports need to be protected against males who are mediocre at best against their fellow males, but dominate against females. Mixed Martial Art competitions are the best example of how men have ended careers of women.

Too many women have been seriously injured to the degree that they are no longer able to compete in the sport in which they've dedicated so much time and effort.

Women need to stand for something and  "Bud Light" sports where applicable. It's a risk, but think of the alternative.

Hundreds detained in Russia for mourning Navalny as Tucker praises Russia above USA

Hundreds of brave Russian's mourned the mysterious death of Russian opposition leader Alexei Navalny. Unfortunately, the mourners all across the country were detained, according to a group that monitors political arrests.

Navalny had been Putin's opponent who, like Donald Trump, became the victim of lawfare. In Trump's case, he just keeps getting indicted for political purposes. In Navalny's case, he was thrown into prison.

On Friday, Russia's prison service announced Navalny's death at an Arctic prison colony. The claim was that the young man, who was 47, “felt unwell after a walk, almost immediately losing consciousness.”

“The facility’s medical workers immediately arrived at the scene and an emergency medical team was called in. All necessary resuscitation measures have been carried out, but they did not yield positive results. Emergency medics confirmed the death of the convict,” the statement added.

According to the Russian-based human rights organization known as OVD-Info, there have been 389 detentions across 39 Russian cities, with no less than 30 detainees ordered to stay incarcerated up to 15 days.

Until Mr. Navalny’s death, many observers believed that the Kremlin would limit repression until after presidential elections in mid-March, when President Vladimir V. Putin is all but assured a fifth term. But many now fear that the arrests portend a broader crackdown. [...]

Specifically, "if you go against Putin, there might be a shootin'." However, Putin prefers poison over bullets and this was likely the reason Navalny felt "unwell" and soon thereafter died.

In Surgut, a city in the Khanty-Mansiysk Autonomous Region in Western Siberia, one of the Navalny mourners, Bakyt Karypbaev, said he was beaten during a five-hour detention after laying flowers at an impromptu memorial for Mr. Navalny. He told The New York Times in a phone interview that officers hit him on his head with their palms, put a gun to his head and forced him to lie on the floor with his arms outstretched. [...]

But Tucker Carlson interviewed Putin and later toured Moscow [obviously told where to go]. He praised the cleanliness of the subway and compared it to the rat-infested subways in New York City, for example. He even went shopping at a market his guide pointed him to and saw that a week's supply of basic food only came to about $104.00 US. He acted as if that wasn't a lot of money for a Russian to spend because, hey, it's only a little over a hundred bucks--pocket change for an American with a decent job.

But $104 for an American is different than it is for a Russian, or anyone from a poor country. Doesn't Tucker understand economics?

Based on Russia's economy, the average family spends 2/3 of their income on food. As of 2020, the average Russian family income is estimated to be around $936 per month, which is equivalent to approximately $11,230 per year. There are 4 weeks in a month, so divide $936 by 4 and you get $234 per week. Spending $104 for food alone makes life difficult for a normal Russian family. Yet Tucker sees this as a pittance for Russian families. And he was in Moscow where salaries are higher than the little jerk-vodka towns outside of Moscow.

Anyway, it looks like Putin is going to maintain power, [and I do mean power] for many years to come, unless someone "Putins" him.

Tucker Carlson needs to reassess his thinking and better understand exactly how dictatorships hide the real trash they're hiding.
