Judge Declines Defense's Creative Attempt to Make the Death Penalty Magically Disappear On the Charlie Kirk Shooting




Defense attorneys apparently hoped that if they complained loudly enough about a prosecutor's media comments, the potential death penalty would simply vanish. A Utah judge wasn't buying it.

The alleged assassin of Turning Point USA founder Charlie Kirk, a scumcrumpet named Tyler Robinson, remains eligible for the death penalty if convicted of aggravated murder after Judge Tony Graf Jr. rejected what amounted to the legal equivalent of asking for a do-over because the other side said something impolite.

The judge found Deputy Utah County Attorney Christopher Ballard in civil contempt for crossing the line during media interviews. Ballard improperly expressed confidence in the overall strength of the case against Robinson, violating a court order limiting public comments, proving he's not the brightest nor the best of attorneys.

That did not mean the prosecution should lose its ability to seek capital punishment, it just means Ballard needs to keep his mouth shut when he's supposed to.

"The court finds that striking the death penalty is grossly disproportionate to the misconduct and legally unavailable in this civil contempt framework," Graf ruled.

Translation: Nice try.

Robinson is accused of fatally shooting Charlie Kirk during a Turning Point USA event at Utah Valley University in September 2025. According to prosecutors, the evidence goes well beyond a single bullet fragment, despite defense efforts to suggest otherwise.

The dispute centered on forensic evidence involving Robinson's grandfather's rifle. The Bureau of Alcohol, Tobacco, Firearms and Explosives determined that the bullet fragment recovered from Kirk could neither definitively identify nor eliminate the rifle as the source because the tool mark analysis was inconclusive. Defense attorneys eagerly promoted that finding as though it were an exoneration.

Not so fast.

The bullet caliber matched the rifle, and investigators also matched a spent shell casing to the weapon. Prosecutors argued they were merely correcting a misleading narrative after headlines falsely implied the firearm had been ruled out altogether.

Judge Graf largely agreed that prosecutors were allowed to "set the record straight." Where Ballard got into trouble was adding his own opinion about Robinson's guilt instead of simply correcting the record.


Rather than imposing the judicial equivalent of a lightning strike on the prosecution, Graf ordered an expanded jury selection process to ensure prospective jurors can remain impartial.

The courtroom battle has increasingly resembled a public relations war. Prosecutors accuse the defense of planting misleading claims through carefully crafted court filings designed to generate favorable headlines. The defense, in turn, accuses prosecutors of "hubris" for responding publicly.

Everyone seems eager to litigate the case on cable news before it reaches a jury.

Robinson has not yet entered a plea and is expected to do so only after his preliminary hearing, which is scheduled for early July. He will continue appearing remotely from jail while both sides keep arguing over microphones almost as much as they argue in the courtroom.

Alexandria Obviously-Commie and dozens of Dems refuse to condemn Kirk's murder



Well, folks, the House of Representatives just gave us another masterclass in political theater, and this time it's wild. On Friday, 58 Charlie Kirk-hating Democrats decided to thumb their noses at a resolution from House Speaker Mike Johnson (R-LA) that honored Kirk and condemned political violence. 

Yes, you read that right, 58 leftists couldn't bring themselves to say, "Hey, maybe assassinations are bad." The resolution, which passed 310-58, denounced Kirk's murder in Utah last week. All Republicans and 95 Democrats managed to find their moral compasses, but 58 others said, "Nah, we're good," and 38 more just shrugged and voted "present" like intellectual cowards.

Johnson's resolution wasn't exactly controversial, unless you're allergic to basic decency. It "honors the life, leadership, and legacy of Charlie Kirk, whose steadfast dedication to the Constitution, civil discourse, and Biblical truth inspired a generation to cherish and defend the blessings of liberty." It also calls on "all Americans, regardless of race, party affiliation, or creed, to reject political violence, recommit to respectful debate, uphold American values, and respect one another as fellow Americans." 

In a speech, Speaker Johnson painted a picture of Kirk as a decent person who could spar in the political arena and still keep it human: "After political debates, Kirk would 'reach out a hand of friendship or offer an arm around the shoulder of someone who he had just defeated in a contest.' Why? Because it wasn't about winning … the policy arguments. It was about the people," Johnson said. "And Charlie loved vigorous debate, but he loved people more." 

A conservative who could out-debate you and still buy you a beer afterward? That’s the kind of unicorn the left apparently can't handle.

So, who were the 58 Democrats who couldn’t stomach this? Oh, just the usual suspects: Reps. Jasmine Mega-lashes Crockett (Texas), Pramila Jayapal (Washington), Alexandria Obviously-Commie (New York), Rashida From the River Tlaib (Michigan), and Ilhan Brotherly Lover Omar (Minnesota). The Squad and friends, basically, doing their best to remind everyone why "unity" is just a buzzword they toss around when it suits them. 

AOC, never one to miss a chance to grandstand in her signature nasal way, took to the House floor to call Kirk a racist. She doubled down on X, writing, "His rhetoric and beliefs were ignorant and sought to disenfranchise millions of Americans, far from 'working tirelessly to promote unity' as asserted by the majority in this resolution. We can condemn his horrific assassination and the scourge of political violence without uplifting these ideas." 

Translation: "Sure, murder is bad, but let's not pretend this guy wasn't the worst and was asking for it." 

House Democrat leadership actually agreed on Thursday to support Johnson's resolution. So, what happened? Did the Squad just wake up on Friday feeling extra spicy, or is this just another day in the life of a party that can't decide if it wants to be the grown-up in the room or the kid throwing a tantrum in the corner?

For a little perspective, earlier this year, a resolution condemning the assassination of Minnesota House Speaker Emerita Melissa Hortman and her husband passed unanimously, with every single Republican on board. No hemming, no hawing, no "but their policies were icky" bullcrap. Republicans managed to condemn violence without playing morality roulette. Funny how that works. 

Meanwhile, the Senate pulled off a rare moment of clarity on Thursday, unanimously passing a resolution to mark October 14, Charlie's birthday, as the "National Day of Remembrance for Charlie Kirk." 

It's ceremonial, sure, but it's a nice gesture in a world that seems to have forgotten how to do those. And if that isn't enough to tug at the heartstrings, a memorial service for Kirk is set for Sunday in Glendale, Arizona, with heavy hitters like President Donald Trump and Vice President JD Vance slated to speak. 

Say what you will about Kirk, but he clearly left a mark. So, here we are: a resolution condemning political violence and honoring a decent person who lived for debate and country, and 58 Democrats couldn't be bothered to sign on. If that doesn't sum up the state of our politics, I don’t know what does. 

Maybe next time they'll vote "present" on common sense, too.

BREAKING: Turning Point USA's Charlie Kirk shot! Latest Update


UPDATE: It has been reported that Charlie Kirk has died. This is a very recent report and has not been confirmed.

On a crisp September 10, 2025, in Orem, Utah, the unthinkable went down. Charlie Kirk, the firebrand conservative and founding leader of Turning Point USA, was gunned down during a speaking event at Utah Valley University. It was 12:10 PM, just 20 minutes into a heated Q&A, when a single shot rang out from the Losee Center, some 200 yards off, piercing the air like a cold blade. 

Grainy videos hit the web fast, showing Kirk under a tent emblazoned with "The American Comeback" and "Prove Me Wrong," jolting back as the bullet struck. Bystanders reported that blood came from his neck. Chaos erupted as people immediately ran for cover. 

Kirk crumpled from his chair, and was quickly whisked away by his security crew to a hospital, his fate still a question mark.

Police nabbed a suspect, but they're keeping tight-lipped on who or why. The FBI, under Director Kash Patel, is circling like hawks, backing up local badges. Utah Valley was locked down, cleared out the campus, and classes canceled for the day.

The outrage poured in from all corners. President Trump took to Truth Social, calling Charlie "a great guy" and begging for prayers. VP JD Vance, Utah's Governor Spencer Cox, and Senators Mike Lee and John Curtis piled on with support. 

Even California's Gavin Newsom, no fan of Kirk's politics, slammed the attack as "disgusting, vile, and reprehensible," preaching against political bloodlust. Gabby Giffords, who survived a 2011 hit, chimed in, horrified, condemning the violence.

Thus far, nobody has blamed President Trump for the shooting, but it's early.

This isn't just a one-off. CNN's tally marks this as the 46th school shooting of 2025, another grim tick in America's rising tide of political mayhem. The motive is still a mystery, and the feds are digging. 

For now, it's wait-and-see in a country that's feeling more like a powder keg by the day. A country where some who have fled their own dangerous country seeking asylum, have themselves ended up victims of crime and murder.

Another RINO gets an override: Utah Gov. Cox's veto of transgender sports ban


It's time to kick the bums out. No, I'm not talking about Biden and his fellow idiot second-in-command. I'm talking about RINOs [aka Republicans In Name Only] and in this case it's Utah Governor Spencer Cox.

Cox vetoed a bill that would ban men from competing in sports against women--let's call it the "Don't Say 'Slow Down Dude, You're Killing the Competition'" bill. The Utah legislature voted on Friday to override Cox's veto of the bill because he believes men who call themselves women, whether they believe it or not, should be allowed to compete against women, whose genital gear and chromosomes proves their claim to womanhood.

The override vote was 56 -18, a supermajority in the Republican-controlled House. Then the Senate clinched the override of the veto by a 21-8 vote. Cox, a sucker for the Democrats, looked like a fool.

In an attempt to cover his RINO butt, Cox issued a statement regarding his veto of H.B. 11, titled Student Eligibility in Interscholastic Activities. He said that while "politically, it would be much easier and better for me to simply sign the bill," he vetoed it because he "tried to do what I feel is the right thing regardless of the consequences."

So Cox took the side of the woke at the expense of women who train hard to compete but lack the physiological advantages men have over them. Women have been losing scholarships to these narcissistic men like Lia Thomas, a guy who by changing his name and keeping his twigs and berries, is able to compete against women in swimming competitions. As a male swimmer, Thomas is mediocre, but as a fake female, he dominates the pool and has to intentionally lose races to show he's just another woman swimming against his peers.

Four GOP lawmakers from each legislative body changed their initial votes in opposition to the measure in order to support the override, according to Utah's Deseret News.

At least one GOP lawmaker in the House who voted against the measure, state Rep. Mike Winder, did not change his stance. He chose not to vote to override Cox's veto and hopefully he will be voted out of office and replaced with a conservative.

State Rep. Kera Birkeland, the bill’s Republican sponsor and an actual woman, said the bill is "purely" about "preserving women’s sports" and cautioned that when "we don’t act, and we just go with the status quo, we just do more harm to both transgender youth and women athletes."

The Utah Jazz, an NBA Communist China supporting team, released a statement following the legislature's override.

"The Utah Jazz oppose discriminatory legislation. We are committed to our values of inclusivity, mutual respect and fair play," the statement said. "Beyond basketball, we hope for an equitable solution that shows love and compassion for all our youth."

I'd like to see more NBA players declare themselves women and play in the WNBA and see how that works out. In fact, there is an instance of a man fighting against women in Mixed Martial Arts and caused life-changing injuries to at least one woman. 

That's what "inclusion" gets you.

Here we have average male competitors who, as fake females dominate in sports. The only exception might be in sports like shooting and archery.

Some states beside Utah have already introduced measures to bar gender dysphoric men students from competing against women in school sports.

Indiana Republican Gov. Eric Holcomb also vetoed a bill that would have banned men with XY chromosomes and penises from competing against women with XX chromosomes and uteruses. 

It's time to vote these people out of office and replace them with Republicans who actually follow the science, and also refuse to allow the killing of babies.

Left-wing anarchist arrested for inciting Capitol riot


Utah resident and left-wing anarchist John Sullivan, 26, was arrested by the FBI and DOJ for inciting a riot inside the U.S. Capitol. There is video evidence of him agitating the crowd and encouraging violence. He obviously was not inspired to do this by President Trump, but perhaps was trying to have fun because anarchists just wanna have fuh-un, yes anarchist just wanna have fun.

Based on public information and information provided by Sullivan in a January 7, 2021 interview, Sullivan is the leader of InsurgenceUSA, a group that organizes leftist protests.

Back in July 13, 2020, the scumcrumpet Sullivan was charged with rioting and criminal mischief by local law enforcement in Provo Utah in regard to a violent protest on June 30th of that year in which a civilian was shot and injured. The case is still pending.

There is another video which seems to have been removed from YouTube that shows a protest in Washington, D.C. where Sullivan is seen telling the crowd over a microphone “we about to burn this s**t down,” “we got to rip Trump out of office . . . f**king pull him out of that s**t . . . we ain’t waiting until the next election . . . we about to go get that motherf***er.” 

Sullivan then can be seen leading the crowd in a chant of, “it’s time for a revolution.”

Finally after the last barricade was breached, Sullivan and others approach the Capitol Building and the scumbag is heard at various points in the video: “There are so many people. Let’s go. This s**t is ours! F**k yeah,” “We accomplished this s**t. We did this together. F**k yeah! We are all a part of this history,” and “Let’s burn this s**t down.”

But as mentioned above, YouTube does not want you to see how the Left "protests," and they removed the video.

Now let me be clear: most of the rioters appear to be Trump supporters and they do not in any way represent Trump's majority nor condone the Capitol breach. Many also agree that Trump should have immediately diffused the situation if he could, but he is no more responsible for it than Bernie Sanders supporters are for the baseball field shooting by one of his supporters that nearly killed Steve Scalise.

It's disgusting that some on the left say that all of us who voted for Trump should have known what was going to happen. Ridiculous. They also say that those of us who voted for him are white supremacists and Nazis. 

Does that mean that since some pedophiles watch Don Lemon, Chris Cuomo and Anderson Cooper  that these hosts are pedophiles? 

Using Lemon logic it would be so.

Paris Hilton opens up about abuse in documentary sure to make money


Paris Hilton, the 39-year-old hotel heiress is finally opening up to the abuse she had to endure while attending private boarding school as a incredibly wealthy teen. She called the abuse "continuous torture."

Hilton will be appearing in an upcoming documentary about her life in which she will be raking in the dough while exposing herself in never-before-heard details about some of the pain she suffered as an adolescent as opposed to exposing herself the other way.

In an interview with People, the former "Simple Life" star revealed she was traumatized daily at the Provo Canyon School in Utah, where she was enrolled for 11 months at age 17.

“The staff would say terrible things. They were constantly making me feel bad about myself and bully me," Hilton said, and explained that the school didn't have a "safe space" where she could go and feel safe in her space.

"I think it was their goal to break us down. And they were physically abusive, hitting and strangling us. They wanted to instill fear in the kids so we’d be too scared to disobey them.”

It's a good thing she never enlisted in the U.S. Marine Corps where bootcamp was exactly that but to the tenth power.

Hilton said the school did not focus on education "at all," which explains her information set.

"From the moment I woke up until I went to bed, it was all day screaming in my face, yelling at me, continuous torture," she said.

Hilton explained that her parents, Rick and Kathy Hilton, made the decision to send her to boarding school after she pulled a series of stunts including "sneaking out and going to clubs and parties" while living free at the Waldorf Astoria Hotel in New York City.

Upon her arrival at Provo Canyon, Hilton said she "knew it was going to be worse than anywhere else" she'd been, but not quite as bad as an early drug trip that blew her away, but not in a good way.

Provo Canyon School did not respond to request made by Fox News, but they released the following statement to People:
"Originally opened in 1971, Provo Canyon School was sold by its previous ownership in August 2000. We therefore cannot comment on the operations or patient experience prior to this time."
Sounds like the previous owner(s) decided to get out of Dodge.

Hilton claimed the school placed students in solitary confinement as punishment "sometimes 20 hours a day."

The alleged abuse led to Hilton suffering from full-blown panic attacks "every single day," and claimed that she felt "like a prisoner" and "hated life" while a prisoner at the school. She claimed that letters or phone calls to her incredibly rich parents were intercepted by staff.

"They would grab the phone or rip up the letters I wrote telling me, 'No one is going to believe you.'"

According to the report, Hilton left the school in 1999 when she was 18. She wouldn't speak about the abuse because she said she felt "ashamed," she alleges.

She plans to watch the documentary on YouTube on September 14, with her parents and believes ". . . it will be good for us, but emotional too. There are no more secrets," she claims, but we all know that there are always more secrets.

Hilton plans to donate all the money the documentary makes to a girls' charity to help those who were victimized as she was.

Just kidding. She plans to keep all the money to add to her collection.

Morticia look-alike busted for pretending to be her daughter

A Utah woman who appeared to be impersonating Morticia Addams from "The Addams Family," was arrested for actually trying to impersonate her 21-year-old daughter during a routine traffic stop last Saturday.

The perp, Heather Garcia, 38, was brought in and booked into the Davis County Jail early Saturday morning on several charges including providing false personal information to a peace officer after she was caught allegedly lying to authorities about her identity to avoid getting arrested for outstanding warrants.

Garcia was driving a silver "Beamer" and was pulled over on Main Street in Farmington. A Davis County cop noticed the car had no license plate, not a very smart move by a woman with outstanding warrants against her.

During a search of her vehicle, police recovered drug paraphernalia and a white powdery substance that looked like cocaine.

When she was stopped, Garcia reportedly identified herself as Mercedes, not the car, but her daughter, adding she was born in 1998.

It wasn't very difficult to see that she was older than she claimed and police soon found that Garcia provided her daughter’s name and eventually made a positive ID.

Garcia was charged with several drug charges including possession or use of a controlled substance, marijuana possession and possession of drug paraphernalia, according to inmate records. She was not additionally charged for being incredibly stupid and for looking like a TV character from a 60s Sitcom.

She was also charged with driving without insurance and driving with a suspended or revoked license or registration and for various makeup infractions against American women.

BREAKING: Man charged with murder in missing U. of Utah student Mackenzie Lueck

Utah -- Salt Lake City police announced that they've taken a man into custody in connection with the disappearance of Mackenzie Lueck, a 23-year-old University of Utah student.

The man, whose name I will not refer to has been charged with her murder. In addition, he will be charged with aggravated kidnapping, desecration of a human body and obstruction of justice, Chief Mike Brown said.

Brown mentioned the accused man's name but said, "I will not be saying the killer’s name again."

The FBI partnered with the local police to come up with the forensic evidence and it appears they are quite confident they have the right person, but are continuing to explore the possibility that someone else may have been involved with the murder.

Mackenzie's DNA was found along with evidence the alleged killer tried to burn along with her body.

She was last seen meeting an unknown person around 3 a.m on June 17th near a Salt Lake City park after she had been dropped off by a Lyft driver.

Further details on the man's arrest – which came a day after his home was searched by police--weren't immediately available. Law enforcement had dug holes in the backyard of the home and removed items from the man's property for further investigation.
If he did it, he should pay the full price
According to a confirmed report by Fox News, the owner of that home had recently expressed a desire to build a secret, soundproofed room with hooks on its walls in the basement of it, a contractor revealed to the outlet on Friday. It should have made the contractor as suspicious as a flight instructor giving lessons to young, Middle East men who don't care to learn how to land a plane.

Brian Wolf, who owns a home repair business in Utah, said the individual reached out to him in April and asked him to give him an estimate for the potential renovation project.

“He slowly added on other requests, like building a secret door and adding hooks to the wall,” Wolf told Fox News, adding that the ultimately turned down the job offer because he was "weirded out" by the requests.

Utah Mom kills cat as her kids watch in horror

Since 1970 about 60,000,000 unborn babies were killed. The CDC reports that in 2005, abortion ended 638,169 lives. But that really doesn't make news like the Utah mother who beat a cat and then "snapped its neck" in front of her children, police reported.

The Utah mother, who reportedly suffers from depression and a dislike of feline creatures, was arrested Saturday, four months after cops say she killed the pussycat. But if you live in New York, you can kill a human one minute before he or she is ready to leave the birth canal and possibly one day cure cancer.

On Sept. 25th, Unified police arrived at Ariane Christine Borg’s home where they discovered her 17-year-old son and 10-year-old daughter “crying hysterically,” the Salt Lake Tribune reported, citing court documents. 

The kids allegedly told police that Borg “beat their cat over and over again and snapped its neck.” 

Borg's daughter told authorities in a November interview that her mom held "the cat by the legs and pounded it repeatedly on the table” before snapping the cat’s neck, according to the Salt Lake Tribune. When the girl tried to stop her, Borg, 36, reportedly hit her on the arm.

In the same vein, doctors who kill the unborn, often do so by dismemberment or by using a vacuum to literally suck out its developing brain. But as horrible as that is, it doesn't make the headlines, not even on Fox News, from where this cat story came.

The dead cat was discovered in the backyard and Borg was found covered in blood from “multiple self-inflicted stab wounds on her abdomen and wrists,” the newspaper reported. Evidently, she went bonkers and seriously hurt herself.

On the other hand, doctors who kill the unborn, tend not to inflict personal physical injury upon themselves or anyone other than the baby. Perhaps this is why the media doesn't say much about it--it isn't very exciting or unusual--it's simply murder.

Borg, according to attorney Steven Burton, spent most of her life battling depression, and her health deteriorated after her medications were adjusted in July. Burton said police went to Borg’s home a week before the incident because she sought help with her mental health, but “no meaningful help was provided,” thanks to Obamacare.

Burton said his client has been responding positively to treatments since October. He called her arrest “devastating,” according to the Desert News.

“It is disappointing to see that after all we have learned about mental illness, our system still re-victimizes those who are struggling, and increases the risk that they will suffer further setbacks," he said. "We hope that those who see this story will urge law enforcement, prosecutors, the media and the Legislature to improve the way we treat mental illness so we can help those who are sick before they reach a point of crisis and tragedy."

Borg was charged with felony child abuse, two misdemeanor counts of child abuse and third-degree torture of a companion animal, according to the Desert News.

Abortion doctors are charged with the responsibility of killing the unborn, which is a more serious form of child abuse.

While mother smoked meth, 3 men accused of raping her 9-year-old girl

Salt Lake City -- The trial has begun for three men accused of raping a 9-year-old girl. Her mother was in the garage smoking methamphetamine.

According to the prosecution, they took the child to a back bedroom, held her down and raped her in 2016.

The girl testified that they threatened to kill her if she told anyone. The attack occurred in rural Uintah County, on the border of Colorado. The child told her mother what happened, two days later.

The defense argue that there is no DNA or other physical evidence implying the child knows what rape is and is lying to the court. The men are being charged with child rape and sodomy, and are: Larson RonDeau, 38, Randall Flatlip, 28, and Jerry Flatlip, 31. 

The defense is claiming the child-welfare workers mishandled the interview with the child and said the mother may have influenced the child's account.

If convicted, it is hoped the three "men" will have cell mates who feel the way most incarcerated men feel about child rape and deal justice accordingly.

A Christmas Miracle

A Pennsylvania woman survived more than a day in frigid wilderness outside the Grand Canyon last weekend. 

She ate twigs, drank her own urine and walked and walked in a desperate attempt to get help for her family stuck on a snowy road.

Kristen Haase, spoke about her sister's horribly-tasting ordeal in an email to Philly.com. Haase and her sister, Karen Klein, along with her husband Eric and their 10-year-old son Isaac, were driving from Bryce Canyon National Park in Utah to the Grand Canyon National Park's north rim for a winter sightseeing adventure.

Never did Karen think she would end up drinking her own pee just to stay alive. Why she chose urine over snow is a mystery.

As the family drove toward the Grand Canyon, snow began to inundate the road. They realized that they weren't going to make it and turned around in their rental car but got stuck in a ditch. 

Karen decided to trek back to the main road about 10 miles away. Maybe she'd be able to flag someone down or at least get cell phone reception.

Eric, a liberal, stayed in the car because someone had to stay back with Kristen and Isaac, just in case.

But when Karen got to the highway, it was closed due to the snow storm. She spotted a sign for the entrance of a Grand Canyon park that was 14 miles from where she shivered, so she decided to give it a go.

Klein was running out of food and water and began feeling the effects of exposure. That's when she decided to give twigs a try and washed it down with her own urine to stay hydrated. 

She walked almost 30 miles for 30 hours without stopping. Eventually, she came upon an empty cabin and found blankets to try and stay warm.

A search crew was out looking for the family and found Karen and the rest of her family. They were treated for frostbite and released from a local hospital.

Jim Driscoll, chief deputy for Coconino County (GO Coconuts!) called the rescue a "Christmas miracle."

Karen Klein is an assistant biology professor at Northampton Community College and earned a master's degree from East Stroudsburg University. Her sister said that she had wilderness survival training in the past and believes that's what saved her life.

When asked what it was like to drink her own urine, Karen shrugged, and with a twinkle in her eye said, "It's an acquired taste."
