Biden's DHS "likely" violated First Amendment by working with Big Tech to censor election content

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press, or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

An injunction was ordered Tuesday on the Department of Homeland Security by a federal court after it found that the agency probably violated the First Amendment by coordinating with social media companies to effectively censor "election-related speech."

The Fifth Circuit Court of Appeals extended the scope of an injunction in place that limits the Biden administration's communication with big tech companies to include the Cybersecurity and Infrastructure Security Agency (CISA) within the Department of Homeland Security.

Of course it wasn't Biden himself who did the communicating now that it's obvious communicating isn't one of Joe's strong points--it's likely someone behind the curtain pulling his strings.

According to Missouri Attorney General Andrew Bailey (R), who is leading the litigation against the Biden administration, CISA is the "nerve center" of the White House's "vast censorship enterprise" and "the very entity that worked with the FBI to silence the Hunter Biden laptop story." 

"CISA was created to protect Americans from foreign attack, and now it has begun targeting its own citizens," Bailey told the outlet.

A three-judge panel determined that CISA was the "primary facilitator" of the FBI's interactions with the social-media platforms and worked in close coordination with the FBI to push the platforms to change their moderation policies to cover "hack-and-leak" content.

The opinion in the order describes CISA’s "switchboarding" operations as "merely relaying flagged social-media posts from state and local election officials to the platforms." But the judge said that "in reality, the practice is ended up being "[s]omething more,'" the order reads.

"CISA used its frequent interactions with social-media platforms to push them to adopt more restrictive policies on censoring election-related speech. And CISA officials affirmatively told the platforms whether the content they had ‘switchboarded’ was true or false," it added.

"Thus, when the platforms acted to censor CISA-switchboarded content, they did not do so independently. Rather, the platforms’ censorship decisions were made under policies that CISA has pressured them into adopting and based on CISA’s determination of the veracity of the flagged information. Thus, CISA likely significantly encouraged the platforms’ content-moderation decisions and thereby violated the First Amendment," the judges said.

Well this is worse than Watergate and J6 combined. 

The injunction stems from a lawsuit brought by Missouri and Louisiana attorneys general against the Biden administration that accused high-ranking government officials of working with giant social media companies "under the guise of combating misinformation" that ultimately led to censoring speech on topics, including Hunter Biden’s laptop, COVID-19 origins and the efficacy of face masks.

If any word in the English language can be used to promote Marxism, that word is "misinformation." Because it's the ones who define what misinformation is, that has the power to shut down dissent.

The attorneys general deposed Dr. Anthony Fauci, and FBI Special Agent Elvis Chan. Federal Judge Terry A. Doughty of the Fifth Circuit ordered the first injunction on July 4th (Independence Day) preventing White House officials and other federal agencies from meeting with tech companies about ways for them to impose "Big Brother" tactics in order to censor social media.

The scathing injunction said the government's actions during the pandemic were akin to "an Orwellian ‘Ministry of Truth.'"

"If the allegations made by Plaintiffs are true, the present case arguably involves the most massive attack against free speech in United States’ history," the injunction states. "In their attempts to suppress alleged disinformation, the Federal Government, and particularly the Defendants named here, are alleged to have blatantly ignored the First Amendment’s right to free speech."

The Justice Department has appealed the court order to the Supreme Court, arguing that the government faced "irreparable harm" because Doughty's order may prevent the federal government from "working with social media companies on initiatives to prevent grave harm to the American people and our democratic processes."

But the truth is, the American people would face "irreparable harm" if these leftists had their way.

Megyn Kelly gives back to NY Times: "grow up . . . do your job'



You don't mess with Megyn Kelly, the Chuck Norris of podcast media, if you can't take the return fire.

Kelly shot back at The New York Times after they accused her of spreading misinformation about the hammer attack on Paul Pelosi, the husband of Speaker Nancy "Hands-a-Blur" Pelosi.

The paper ran an article on Saturday where they listed “elected officials and candidates” along with “prominent figures” who had, in their words, “spread misinformation or cast doubt on the attack.” One of those on the list was Kelly. The former newspaper said that she “[R]aised doubts that all facts were being disclosed.”

Kelly returned fire on Monday, tweeting: 
The NYT lists me as a spreader of misinfo re the P Pelosi attack bc I “raised doubts that all facts were being disclosed.”
It’s called JOURNALISM. SFPD clearly has more to disclose but if u ask for it, you’re a “misinfo” spreader like @Miguelnbc. Grow up, NYT & DO YOUR JOB.
Speaking on her podcast on Oct. 31, Kelly said, “We are learning more about who the intruder was, but many questions remain about the circumstances of the crime, which police have been fairly tight-lipped about and actually contradictory as well.” 

In fact, NBC lost the story completely. 

She condemned the media, saying they were “rushing to make this about right-wing political violence, and not just that, not just right-wing political violence, this is about January 6, don’t you know? This is about January 6, like everything needs to be for the Democrats today; not homelessness, not crime, not mental illness, January 6; back to that. They will use it for all it’s worth and then some.”

Kelly’s assertion that the media was trying to turn the attack on Pelosi into another instance connected to January 6 was further confirmed in the article which claimed she was spreading misinformation. The article stated:
The flood of falsehoods showed how ingrained misinformation has become inside the G.O.P., where the reflexive response of the rank and file — and even a few prominent figures — to anything that might cast a negative light on the right is to deflect with more fictional claims, creating a vicious cycle that muddies facts, shifts blame and minimizes violence. It happened after the Jan. 6, 2021, attack on the Capitol, which was inspired by Mr. Trump’s lie of a stolen election, and in turn gave rise to more falsehoods …

“The press has gone deep, dark down the rabbit hole about trying to say, ‘This is all about January 6’ because the lunatic’s latest iteration of craziness was focused on some QAnon theories, things along those lines, notwithstanding his BLM flag and his LGBTQ flag out in front of it,” Kelly noted, referring to Pelosi’s alleged attacker.
The election is tomorrow, Nov. 8, and the Democrats have no platform to stand on other than personal attacks, Jan. 6, and "Trump is a bad man so vote for me."

Brian Stelter: there's a "fear" Elon Musk is Twitter's biggest shareholder


Is it karma that the Compromised News Network's Brian Stelter's initials are BS? Probably. 

The leftist "correspondent" seemed nervous and clammy about the world's richest person, Elon Musk becoming Twitter's largest shareholder at 9.2 percent, about twice as much as founder Jack Dorsey.

Musk woke up the nation Monday with an SEC filing the purchase of Twitter stock, nearly 73.5 million shares which caused the new price of the stock to rise 25 percent a the possibility of freedom to ring.

Musk is a "free speech guy" and recently appeared in a Babylon Bee interview, a company that was banned from Twitter for a satirical tweet saying that Rachel Levine, a man who believes himself to be a woman, won the "Man of the Year Award."

Twitter also banned former President Donald Trump and many others on  the right because they don't like what they have to say. What the Left labels 'misinformation" is information they disagree with and, in most cases, historically, conservatives have been more accurate with the information than the Left. And let's face it: a man is a man and a woman is a woman but got people banned from Twitter and other platforms just for pointing that out.

Musk has not been shy about saying Twitter is "failing to adhere to free speech principles" which he correctly insisted "fundamentally undermines democracy." He also asked his 80.3 million Twitter followers if a new social media platform was "needed."

On Monday, "Reliable Sources Daily," a show with an oxymoron for a title and a moron for a host, Brian Stelter who is "not gay," spoke about Musk's "surprise" move in a panel discussion with Clare Duffy. He asked her "whether he'll [Musk] continue to buy shares, become a bigger investor, and take action here."

"Elon has criticized Twitter for not allowing free enough speech. And so I think the big question will be whether he'll try to, you know, get Twitter to change its content moderation policies. He also suggested that maybe Twitter should make its algorithm open source so that people know how it works. So I think those are some of the changes we could potentially see, but, you know, Elon always also talks a big game," Duffy, not a fan of free speech said. "He knew what he was doing when he was sending out those tweets. And so, you know, it does suggest that he's gonna try to shake things up at Twitter."

By 'shake things up' Duffy means that he will allow diversity of opinions and not ban people for them, this is an unacceptable concept for the Left.

After CNN Business writer Sara O'Brien suggested "everyone wants to follow what the billionaires are doing" in response to Twitter's soaring stock value, Stelter, who may be suffering from trichotillomania, offered a outlook for anti-First Amendment advocates.

"There's interest in billionaires, there's celebration of the Musk. There's also fear, I think, sometimes or wariness of- okay, so here's the richest man on the planet who just bought a big chunk of one of our most important communications tools," Stelter almost lisped. "He's also one of the biggest owners of satellites in the world. So he's incredibly powerful, incredibly, I don't know, am I allowed to use the word strange when talking about Elon Musk?"

Yes, you are allowed to say it Brian, because there's that old First Amendment thingy.
