Biden's DHS "likely" violated First Amendment by working with Big Tech to censor election content

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press, or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

An injunction was ordered Tuesday on the Department of Homeland Security by a federal court after it found that the agency probably violated the First Amendment by coordinating with social media companies to effectively censor "election-related speech."

The Fifth Circuit Court of Appeals extended the scope of an injunction in place that limits the Biden administration's communication with big tech companies to include the Cybersecurity and Infrastructure Security Agency (CISA) within the Department of Homeland Security.

Of course it wasn't Biden himself who did the communicating now that it's obvious communicating isn't one of Joe's strong points--it's likely someone behind the curtain pulling his strings.

According to Missouri Attorney General Andrew Bailey (R), who is leading the litigation against the Biden administration, CISA is the "nerve center" of the White House's "vast censorship enterprise" and "the very entity that worked with the FBI to silence the Hunter Biden laptop story." 

"CISA was created to protect Americans from foreign attack, and now it has begun targeting its own citizens," Bailey told the outlet.

A three-judge panel determined that CISA was the "primary facilitator" of the FBI's interactions with the social-media platforms and worked in close coordination with the FBI to push the platforms to change their moderation policies to cover "hack-and-leak" content.

The opinion in the order describes CISA’s "switchboarding" operations as "merely relaying flagged social-media posts from state and local election officials to the platforms." But the judge said that "in reality, the practice is ended up being "[s]omething more,'" the order reads.

"CISA used its frequent interactions with social-media platforms to push them to adopt more restrictive policies on censoring election-related speech. And CISA officials affirmatively told the platforms whether the content they had ‘switchboarded’ was true or false," it added.

"Thus, when the platforms acted to censor CISA-switchboarded content, they did not do so independently. Rather, the platforms’ censorship decisions were made under policies that CISA has pressured them into adopting and based on CISA’s determination of the veracity of the flagged information. Thus, CISA likely significantly encouraged the platforms’ content-moderation decisions and thereby violated the First Amendment," the judges said.

Well this is worse than Watergate and J6 combined. 

The injunction stems from a lawsuit brought by Missouri and Louisiana attorneys general against the Biden administration that accused high-ranking government officials of working with giant social media companies "under the guise of combating misinformation" that ultimately led to censoring speech on topics, including Hunter Biden’s laptop, COVID-19 origins and the efficacy of face masks.

If any word in the English language can be used to promote Marxism, that word is "misinformation." Because it's the ones who define what misinformation is, that has the power to shut down dissent.

The attorneys general deposed Dr. Anthony Fauci, and FBI Special Agent Elvis Chan. Federal Judge Terry A. Doughty of the Fifth Circuit ordered the first injunction on July 4th (Independence Day) preventing White House officials and other federal agencies from meeting with tech companies about ways for them to impose "Big Brother" tactics in order to censor social media.

The scathing injunction said the government's actions during the pandemic were akin to "an Orwellian ‘Ministry of Truth.'"

"If the allegations made by Plaintiffs are true, the present case arguably involves the most massive attack against free speech in United States’ history," the injunction states. "In their attempts to suppress alleged disinformation, the Federal Government, and particularly the Defendants named here, are alleged to have blatantly ignored the First Amendment’s right to free speech."

The Justice Department has appealed the court order to the Supreme Court, arguing that the government faced "irreparable harm" because Doughty's order may prevent the federal government from "working with social media companies on initiatives to prevent grave harm to the American people and our democratic processes."

But the truth is, the American people would face "irreparable harm" if these leftists had their way.

Ministry of Truth czar spreads more disinfo: Kamala did not sleep her way to the top




Nina Jankowicz [pictured above singing to a Mary Poppins tune about Republican disinformation] is slated to be heading the DHS's Disinformation Governance Board to weed out information that goes against what information the board deems accurate. 

For one, she says that the claim whereby Kamala Harris [she's apparently our Vice President and southern border expert] slept her way to the top is disinformation, in spite of the fact that Kamala slept with San Francisco's mayor Willie Brown and thereafter got higher government positions. If that isn't sleeping one's way to the top, it must then be considered screwing one's way in an upward mobile fashion for political gain.

While it has been nearly two weeks since the DHS announced the Big Brother is Watching You Board, since April 27th, there hasn't been much talk by the Left about it, nor how it plans to prevent free speech, coincidentally, during the approach of the midterm elections. 

Also, they have kept quiet about Nina Jankowicz's partisan, hard-left background.  However, Jankowicz made an appearance for 84 seconds on the Mayday edition of "Meet the Press," but other than that, nothing.

Her expertise was in full view last October in Cleveland when she spoke about "Disinformation and Democracy: Civic Discourse in the Digital Age."

Townhall noted how she opined on Critical Race Theory:
"Critical Race Theory has become one of those hot-button issues that the Republicans and other, you know, 'disinformers' who are engaged in disinformation for profit, frankly — there are plenty of, you know, media outlets that are making money off of this too — have seized on. I live in Virginia, in Loudoun County, that's one of the areas where people have really honed in on this topic."
Jankowicz discussed the leftist's idea of the threat of disinformation but forgot to mention what she had previously said about the Russian dossier authenticity and about Hunter Biden's sticky laptop as Russian disinformation before going after parents and those who oppose Critical Race Theory (CRT).

She claimed that several "media outlets" are pushing CRT as she spoke to her audience of naive disinformed [a word I just made up so don't let the red squiggle bother you]. There has been no media coverage other than Fox News and some conservative outlets.

At the start of COVID-19, on March 4, 2020, Jankowicz was calling for platforms to refuse advertising for face masks, as reported by Josh Barro, an actual journalist. Other so-called journalists didn't even bother to question this.

Now the GOP is questioning not only the unconstitutional idea of a disinformation board, but the hard-left lunatic whose record of disinformation is about as accurate as Joe Biden's is on U.S. foreign policy strategy.

Mayorkas admits he's oblivious about top staff hirings: he's just not into it

Homeland Security Incompetent Secretary Alejandro Mayorkas admitted he doesn't know anything about the top woman, Nina Jankowicz, who was selected to head the department's Disinformation Governance Board. He also doesn't know his butt from a hole in the ground, how many terrorists have crossed into the country on his watch, and who killed JR. In a word, the George Soros-backed head of DHS is an idiot, but a useful idiot.

Mayorkas did not know that Jankowicz has taken many public stands, for example, the Hunter Biden laptop, that was proved wrong as it was authenticated. He also did not know that Jankowicz made ridiculous videos on TikTok that featured her singing politically inspired songs to show tunes like Mary Poppins' "Supercalifragilisticexpialadocious." [Not sure I spelled it correctly but there's a long red line beneath the word.]

In spite of the fearless DHS leader supposedly having no clue as to who this lunatic is, Mayorkas announced last week that the board would be headed by Jankowicz and touted her abilities.

During a Wednesday hearing, Sen. John Kennedy (R-LA) tried to get Mayorkas to explain what the DHS know about Jankowicz when they put her in charge of the new "Ministry of Truth" as some have called it.

“I am in awe of Ms. Jankowicz. I have watched her with slack-jawed astonishment,” Kennedy said. “Who picked her?”

Mayorkas answered “the Department of Homeland Security selected Ms. Jankowicz.”

“Who at the department picked her?” Kennedy asked.

“Senator, we don’t discuss our internal hiring processes,” Mayorkas replied, acting as if a government selection process for a public position is top secret. “I am the secretary of homeland security and ultimately I am responsible.”

“When the department picked her, did it know that she had said that Mr. Hunter Biden’s laptop is Russian disinformation?” Kennedy asked.

“I was not aware of that. We do not discuss the internal hiring process. Ultimately, as the secretary I am responsible for the decisions of the Department of Homeland Security,” Mayorkas said, as he tried to skirt responsibility.

“When the department picked Ms. Jankowicz, did it know that she had vouched for the veracity of the Steele dossier?” Kennedy asked.

“Senator, let me repeat myself and add an additional fact. One, we do not discuss internal hiring processes. Two, I was not aware of that fact,” Mayorkas said.

“Three, as the secretary of homeland security I am responsible for the decisions of the department and four, it is my understanding that Ms. Jankowicz is a subject matter expert in the field in which she will be working on behalf of the department.”

“I can tell,” Kennedy said in reply because he is not only a hundred times smarter than Mayorkas, he's also funny.

Mayorkas called the board a “working group” [a somewhat Communist-sounding term] and said it would be mostly concerned with ensuring DHS respects free speech rights, according to The Washington Times.

“The working group does not have operational capacity and authority. It is to make sure there are policies in place, standards in place, to protect the very rights about which you inquired,” he told Kennedy with a straight face to hide his lie.

Kennedy advised Mayorkas to find out the person who actually hired Jankowicz, the New York Post reported. He added, I would fire him on the spot."

Is the ship of fools sinking? Two more White House staffers quit


What's going on in the White House? Two more staffers are making their exit and another is on a leave of absence. Could it be they see the scribbling on the wall? Even White House press secretary Jen Psaki has her plans to leave and join MSNBC as their disinformationista, kind of like a Starbucks barista but with instead of serving "gourmet" coffee, she will be serving fake news.

Even Vice President Kamala Hahaharris' staffers are leaving her office faster than a New York City traffic light goes from red to green and a cabby blows his horn.

Jeff Nussbaum [his surname is German for "nut tree"] said on Tuesday that his last day was that Tuesday and he looked as if he had a new lease on life.

Another White House staffer to say goodbye is Elizabeth Wilkins, a senior adviser to Ron Klain, the chief of staff and possibly the guy with his hand up Biden's nether regions pulling the strings. Wilkins is leaving to be the director of the FTC's Office of Policy Planning. Reema Shah, deputy associate counsel for the White House has taken Wilkins' advisory role.

Daleep Singh, another staffer is taking a leave of absence "for family reasons." Mr. Singh, not the sharpest tack in the box in the area of supply and demand, made a claim that drilling for more oil would not affect the price of oil.


He is a deputy national security adviser and deputy at the National Economic Council, and appears to know as much about both responsibilities as a urinal cake dispenser technician knows about rocket science. His own property was illegally entered and police were called and he is supposed to provide security for an entire country!

Singh has also overseen the Biden administration’s sanctions against Russia since Putin’s invasion of Ukraine and the person to decide on the donut varieties in the morning when staff arrives.

Due to the inconvenient timing of Singh's departure, it's probable that the decision wasn't his but the person responsible for putting words into Biden's Teleprompter. He is expected to begin his leave of absence next month but the length of the leave wasn’t reported.

At this time, Singh's replacement does not appear to be determined. It may take two people: one as deputy national security adviser and deputy at the National Economic Council, and another person as donut maven. [Biden likes the chocolate one with the creamy inside--it surprises him every time.]

For now the White House refuses to comment and people who believe they know will first have to pass their prognostications through Nina Jankowicz, the future head of the Ministry of Truth.
