Federal Judge Just Smacked Down Biden's Transgender Overreach—Again

Will she get home in time to watch Judge Judy?

Oh, look, another day, another federal judge reminding the woke crowd that biology isn't a suggestion. On Thursday, U.S. District Judge Louis Guirola Jr. tossed out a Biden-era rule that tried to shoehorn gender identity into Title IX protections and strong-arm doctors into performing transgender procedures like it was just another flu shot.

Guirola backed Tennessee and a posse of 14 other red states that dragged the Department of Health and Human Services (HHS) to court over this nonsense. The judge basically said HHS went full rogue, twisting "sex discrimination" into something it was never meant to be.

"Congress only contemplated biological sex when it enacted Title IX in 1972," Guirola wrote, dropping truth bombs like it's 1972 all over again. "Therefore, the Court finds that HHS exceeded its authority by implementing regulations redefining sex discrimination and prohibiting gender-identity discrimination."

This gem of a rule dropped on May 6, 2024, back when Biden's crew was still pretending they could rewrite reality with a pen stroke. Fast-forward to the Trump era, and the states weren't taking any chances. They figured why wait for the next round of bureaucratic bullying? 

Trump's HHS lawyers tried to calm everyone down, swearing up and down that with the boss cracking down on transgender ideology, no one's getting sued over this. But Guirola wasn't buying the "trust us, bro" routine. He called the threat of enforcement "real" and said sorting this out now would finally give everyone the clarity they've been begging for.

Under this rule, states would've been stuck footing the bill for transgender surgeries through Medicaid and Medicare, while hospitals lost the right to keep bathrooms and locker rooms where they belong—segregated by actual biology. It would've nuked state health exchanges that dared to say no to the procedure parade.

Guirola laid it out plain: "When it enacted Title IX, Congress's concern was prohibiting sex discrimination in education. It was particularly concerned with inequality that female students experienced. It did not at that time contemplate gender identity, transgender status, or 'gender-affirming care,'" he wrote. In other words, Congress wasn't dreaming up a future where "sex" means whatever TikTok says it does.

Tennessee AG Jonathan Skrmetti was popping champagne over the win, and who could blame him?

"When Biden-era bureaucrats tried to illegally rewrite our laws to force radical gender ideology into every corner of American health care, Tennessee stood strong and stopped them," Skrmetti said. "This decision restores not just common sense but also constitutional limits on federal overreach, and I am proud of the team of excellent attorneys who fought this through to the finish."

Skrmetti hammered home how this would've forced hospitals into sex-segregated space chaos and made states subsidize the whole "gender-affirming" circus via Medicaid. 

The suit had the full Republican AG squad from Mississippi, Alabama, Georgia, Indiana, Kansas, Kentucky, Louisiana, Nebraska, Ohio, Oklahoma, South Carolina, South Dakota, Virginia, and West Virginia all piling on, because when it comes to fighting federal fairy tales, strength in numbers.Meanwhile, President Trump, never one to let Biden's legacy linger—is on a tear with executive orders to undo the transgender takeover. He's already kicked off a full audit of every Biden move on this front, making sure the madness gets the boot it deserves. 

Score one for sanity, zero for the ideologues.

Nonprofit got $22 million in gov't grants to teach kids about sex toys

Here we go again, guys. Get ready for another wild ride through the swamp of government waste and moral decay and don't forget to hold your nose.

The feds have been funneling your hard-earned tax dollars—over $22 million since 2016, to be exact—into a nonprofit called the Center for Innovative Public Health Research (CIPHR). Sounds harmless, right? Wrong. This outfit’s been cooking up “health education programs” that are less about health and more about pushing deviant agendas on American kids. And trust me, it’s as bad as it sounds.

Let’s start with their Girl2Girl program, launched in 2017. It’s billed as a “sex ed program just for teen girls who are into girls,” targeting kids mostly 14 to 16 years old. 

The program’s website brags about sending “daily text messages . . . about things like sex with girls and boys.” Dig a little deeper, and you find out those texts are diving into “lube and sex toys,” “different types of sex and ways to increase pleasure,” and what it’s like growing up as a teen girl into girls. Oh, and here’s the kicker: they tell these kids to make their “own decision[s]” about joining the program and—get this—not to bother telling their parents if they don’t feel like it. Yes, they’re coaching minors to keep secrets from mom and dad. 

Now why would they do that?

Then there’s Transcendent Health, CIPHR’s latest brainstorm from 2023, which snagged a cool $1.3 million in federal cash before the grant ran dry last month. This one’s aimed at “gender minority teens” and had them filling out forms asking if they’d had sex “with a transgender guy” or “with a non-binary person.” Real classy, right? They’re out here grilling kids on their sex lives like it’s just another Tuesday.

At the helm of this circus is CIPHR’s CEO, Michele Ybarra, who seems to have zero regard for parents’ rights. In a 2022 Brown University webinar, she laid it all bare, talking about how her team preps “young person[s]” for focus groups. 

Here’s her gem, verbatim: “If we’re doing focus groups, we will ask, ‘Okay, so what happens if somebody comes into the room and sees words like penis and sex toys on your screen—on your computer screen or on your phone? What if it’s your mom?’” 

Let that sink in. She’s not just okay with kids seeing this stuff—she’s planning for it and making sure they’ve got a game plan to hide it.

Ybarra’s been at this for years. Back in 2017, she was presenting survey results from CIPHR that asked 14- to 16-year-olds if they’d had “receptive anal sex” or “insertive anal sex.” In that same 2022 webinar, she doubled down, saying her team “wanted to know a bit more about when and why and where trans kids are choosing to have sex.” 

Look, I’m no prude, but this is straight-up predatory. These are children, not lab rats for her creepy social experiments. It's as if she gets off on their responses.

Here’s the bottom line: the federal government has no business bankrolling this garbage. Programs that beam explicit messages to kids and tell them to lie to their parents don’t deserve a dime of taxpayer money. The Department of Health and Human Services needs to pull the plug on CIPHR’s contracts ASAP and slam the door on any future grants.

NY State Dems shut down child's lemonade stand

A 7-year-old entrepreneur, little Brendan Mulvaney, has been put out of business by the bureaucrats at the New York State Health Department.

The leftists closed down his lemonade stand because he was charging a fair price to his customers and undercutting the rip-off price the nearby county fair was charging: $0.75 vs. $7.00!

The shutdown happened after greedy vendors at the fair complained he was taking away their business, and while they could have broken a few bones, they decided just turning him in would be less of a hassle.

Young Mulvaney was selling lemonade, water and Sno-cones from the porch of his parent's home, located right outside the Saratoga County Fair in upstate New York. [They also have a fine racetrack there].

A woman clad in a Health Department tee-shirt showed up on Friday and shut down the kid's operation because he didn't have a permit.

Perhaps he would have gotten a permit, but he is too short to reach the counter.

The state officials have batted it back and forth, first they said the Health Department doesn't regulate lemonade stands, and they initially apologized when the story went public.

"We are working to better understand the situation but in the meantime want to assure the community that DOH does not issue permits for or oversee lemonade stands," spokesperson Jill Montag told The Post.

But just 24 hours later, the DOH did "an Obama" and said a permit was required after all. It costs $30 for the year and they even said they would help the family get the permit [by providing little Brendan with a step-stool].

There was no reaction from the block of wood known as Gov. Andrew Cuomo or his office.
