Federal judge blocks Biden admin mask mandate on public transportation

Masks are also useful for catching drool

A federal judge voided the Biden-Harris-Klain-Obama administration's mask mandate for people using public transportation such as buses, trains and planes.

The unscientific mandate from the Centers for Disease Control and Prevention applies to people as young as 2 years old, for no particular reason as there is more danger for a 2-year-old from the flu than there is from Covid-19 and any of its mutations. 

The mandate had been slated to expire several times but PINO Biden mumbled something about it extending to May 3rd, as if the virus has a calendar or a smart phone. Monday's ruling put a kibosh on the lunacy.

The ruling came from U.S.. District Court Judge Kathryn Kimball Mizelle, emanating from a case brought in Florida federal court by Health Freedom Defense Fund, Inc. and frequent air travelers Ana Daza and Sarah Pope against the alleged Biden administration. 

Judge Mizelle determined that the mandate violated the Administrative Procedure Act by being outside the scope of the CDC's authority, was "arbitrary" and "capricious" and not going through the required notice and comment period for federal rule-making.

In other words, the CDC makes crap up as they go along to do what the White House tells them to do.

Judge Mizelle examined the section of the Public Health Services Act of 1944 that was the basis for the mandate. That law allows the CDC "to make and enforce such regulations" deemed "necessary to prevent the introduction, transmission, or spread of communicable diseases from foreign countries into the States[.]" To this end, the law says that CDC can utilize "inspection, fumigation disinfection sanitation, pest extermination, destruction of animals or articles found to be so infect or contaminated as to be sources of dangerous infection to human beings, and other measures[.]" The administration, the judge noted, has claimed that the mask mandate falls under "sanitation."

Well, the one thing they got right was that the masks have created a sanitation problem. If someone could come up with a way to completely sanitize discarded masks found all over the place, as Trump might phrase it, they would become a millionaire, or else be stuck with millions of cleaned up masks.

The judge noted that one could view "sanitation" as being an active measure to clean or as a preventative measure to keep something from getting dirty or infected, but through an examination of the statutory language, she determined it was the former.

"The context of [the statute] indicates that ‘sanitation’ and ‘other measures’ refer to measures that clean something, not ones that keep something clean," Mizelle wrote. "Wearing a mask cleans nothing." 

It certainly doesn't clean Hunter Biden's mind nor laptop.

Immediately following the announcement, United Airlines told employees that the mandate will remain in effect until they receive guidance from the federal government on how to proceed, convincing many of us who are sick and tired of this nonsense to fly Delta.
